Wallpaper Cropper - Terms of Use
Acceptance of Terms
By accessing or using wallpapercropper.com (the "Platform"), you agree to these Terms of Use and all policies referenced herein. If you do not agree, do not use the Platform.
User Eligibility and Compliance
You represent that you are of legal age and have authority to agree to these Terms. You must comply with all applicable laws and regulations in your territory. You may not use the Platform to violate any law or third-party rights, including copyright, trademark, privacy, or publicity rights.
User Content and Conduct
You are solely responsible for all content you upload, create, share, or make public. You confirm you own or have all necessary rights to submit that content and that it does not infringe any third-party rights. You must not upload unlawful, harmful, abusive, defamatory, obscene, or unauthorized material, nor attempt to interfere with or disrupt the Platform.
License and Data Control
You grant Wallpaper Cropper a perpetual, worldwide, irrevocable, transferable, sublicensable, royalty-free license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, display, commercialize, and create derivative works from any content or data you submit or generate on the Platform, for any lawful purpose (including analytics, marketing, product development, and AI/ML training). We may edit, modify, anonymize, or remove your content at our sole discretion, without notice, reason, or compensation.
Data Deletion, Modification, and Access
We may delete, alter, restrict access to, or refuse to host any data or content at any time, for any reason or no reason, without notice. We are under no obligation to store, back up, retain, or make available any data. Data loss or unavailability may occur at any time.
Service Availability
The Platform may be suspended, limited, or discontinued at any time without notice. We make no commitment to maintain uptime, continuity, or feature availability. We may change or remove features at our discretion.
Cooperation and Disclosure
We may monitor Platform activity and cooperate with law enforcement, regulators, or rights holders as permitted by law. This may include preserving, disclosing, or providing account details, usage logs, IP addresses, and uploaded content to comply with legal processes or protect our rights.
No Warranty
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Use is at your sole risk.
Device and Usage Risks
You are responsible for your own devices, connectivity, and data charges. We are not liable for any harm to devices or systems arising from use of the Platform (for example, increased device load, overheating, data consumption, or hardware stress from loading images or other content).
Assumption of Risk
You accept full responsibility for how you use the Platform and any consequences. You agree the Platform may contain user-generated content that could be inaccurate, offensive, or unlawful, and we are not responsible for user conduct or submissions.
Limitation of Liability
To the maximum extent permitted by law, Wallpaper Cropper and its owners, operators, affiliates, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business, arising from or related to your use of the Platform. In all cases, our aggregate liability shall not exceed the greater of (a) the amount you paid to us in the three months preceding the claim, or (b) one U.S. dollar.
Indemnity
You agree to defend, indemnify, and hold harmless Wallpaper Cropper and its owners, operators, affiliates, and service providers from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your content, your use of the Platform, or your violation of these Terms or applicable law.
Termination and Suspension
We may suspend or terminate access to the Platform, remove content, or block accounts at any time, for any reason or no reason, without notice. Upon termination, any rights granted to you cease immediately.
Third-Party Links and Services
The Platform may link to third-party sites or services. We do not control and are not responsible for those sites or their content. Use of third-party services is at your own risk.
Changes to Terms
We may update these Terms at any time. Updated Terms are effective when posted. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
Severability and Waiver
If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver of our right to do so later.
Governing Law
These Terms are governed by applicable law in the jurisdiction where Wallpaper Cropper is based, without regard to conflict of law principles. Where local law requires, you also agree to comply with laws in your own territory when using the Platform.
